AN ACT to amend the executive law, in relation to requiring local disas-
ter preparedness plans to be made widely available to the public
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 23 of the executive law is amended by adding a new
subdivision 8 to read as follows:
8. ALL LOCAL DISASTER PREPAREDNESS PLANS PREPARED PURSUANT TO THE
AUTHORIZATION OF THIS SECTION SHALL BE MADE WIDELY AVAILABLE TO THE
PUBLIC. ANY COUNTY, CITY, TOWN, OR VILLAGE PREPARING SUCH A PLAN MAY
WITHHOLD SPECIFIC SECURITY-RELATED INFORMATION FROM PUBLIC DISCLOSURE
ONLY IF THE STATE EMERGENCY MANAGEMENT OFFICE, AS DEFINED IN PARAGRAPH
(E) OF SUBDIVISION ONE OF SECTION TWENTY-NINE-E OF THIS ARTICLE, DETER-
MINES THAT THERE IS A COMPELLING SECURITY REASON TO WITHHOLD SUCH INFOR-
MATION FROM THE PUBLIC AND APPROVES OF SUCH WITHHOLDING OF DISCLOSURE
THEREOF.
S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law.
