AN  ACT to amend the social services law, in relation to making an indi-
  vidual's Medicaid account information available through the use of the
  internet

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  363-a  of  the social services law is amended by
adding a new subdivision 5 to read as follows:
  5. THE DEPARTMENT OF HEALTH SHALL ENSURE THAT THE ACCOUNT  INFORMATION
OF  EVERY  INDIVIDUAL  WHO  IS A RECIPIENT OF MEDICAL ASSISTANCE THROUGH
MEDICAID IS AVAILABLE FOR ON-LINE VIEWING BY SUCH INDIVIDUAL THROUGH THE
USE OF THE INTERNET. THE DEPARTMENT OF HEALTH SHALL TAKE WHATEVER  MEAS-
URES  NECESSARY TO SAFEGUARD THE PRIVACY OF THE MEDICAL RECORDS OF THESE
INDIVIDUALS.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law. Effective immediately  the  commissioner  of
the  department  of  health may take any action necessary for the timely
implementation of this act on its effective date.
