2009-A5138 (ACTIVE) - Summary

Authorizes the commissioner of education to take control of any high school that remains a school under registration review for three years from the board of education of the city of New York and to remand responsibility for such schools to the local school board or a not-for-profit corporation and to reallocate funds; permits a student attending a high school under registration review to attend any other public high school.

AN ACT to amend the education law, in relation to schools  under  regis-
  tration review

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 2554-d
to read as follows:
  S 2554-D. HIGH SCHOOLS UNDER REGISTRATION REVIEW. 1.   NOTWITHSTANDING
ANY  OTHER  PROVISION  OF  LAW, THE COMMISSIONER IS HEREBY AUTHORIZED TO
REMOVE RESPONSIBILITY FOR ANY HIGH SCHOOL THAT REMAINS  A  SCHOOL  UNDER
REGISTRATION REVIEW FOR A PERIOD OF THREE YEARS FROM THE BOARD OF EDUCA-
TION OF THE CITY OF NEW YORK AND REMAND SUCH RESPONSIBILITY TO THE LOCAL
SCHOOL BOARD OR A NOT-FOR-PROFIT CORPORATION.
  2.  THE COMMISSIONER MAY APPOINT A SPECIAL DEPUTY TO DIRECT AND SUPER-
VISE CORRECTIVE  ACTION  FOR  SCHOOLS  UNDER  REGISTRATION  REVIEW  THAT
CONTINUE TO DECLINE.
  3.  NOTWITHSTANDING  ANY  OTHER  PROVISION OF LAW, THE COMMISSIONER IS
HEREBY AUTHORIZED TO REALLOCATE RESOURCES TO IMPLEMENT CORRECTIVE ACTION
AS HE DEEMS NECESSARY FOR SCHOOLS UNDER REGISTRATION REVIEW.
  4. NOTWITHSTANDING ANY OTHER PROVISION OF LAW,  STUDENTS  ENROLLED  AT
HIGH  SCHOOLS UNDER REGISTRATION REVIEW MAY ATTEND ANY OTHER PUBLIC HIGH
SCHOOL WITHOUT BEING SUBJECT TO ZONING RESTRICTIONS.
  S 2. This act shall take effect on the first of July  next  succeeding
the date on which it shall have become a law.
