AN  ACT to amend the education law, in relation to requiring instruction
  in organ, eye and tissue donation in senior high schools

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The section heading of section 804 of the education law, as
amended  by  chapter  401  of  the  laws  of 1998, is amended to read as
follows:
  Health education regarding alcohol, drugs, tobacco  abuse  [and],  the
prevention  and  detection of certain cancers, AND INSTRUCTION IN ORGAN,
EYE AND TISSUE DONATION.
  S 2. Section 804 of the education law  is  amended  by  adding  a  new
subdivision 3-b to read as follows:
  3-B.  INSTRUCTION  REGARDING ORGAN, EYE AND TISSUE DONATION SHALL BE A
PART OF A REQUIRED HEALTH EDUCATION COURSE AT  THE  SENIOR  HIGH  SCHOOL
LEVEL,  IN ADDITION TO CONTINUED HEALTH GUIDANCE IN SENIOR HIGH SCHOOLS.
SUCH INSTRUCTION SHALL PROVIDE INFORMATION ABOUT THE NEED FOR ORGAN, EYE
AND TISSUE DONATION AND THE BENEFITS OF DONATION TO RECIPIENTS, AS  WELL
AS  INFORMATION  ABOUT  NEW  YORK  STATE  LAW RELATIVE TO ORGAN, EYE AND
TISSUE DONATION, INCLUDING HOW TO BECOME A DONOR.   CURRICULUM SHALL  BE
DEVELOPED  IN  COORDINATION  WITH  NEW  YORK STATE'S FEDERALLY CERTIFIED
ORGAN PROCUREMENT ORGANIZATIONS, AND  ACCREDITED  OR  LICENSED  EYE  AND
TISSUE  BANKS.  ANY  SUCH  COURSE  SHALL BE TAUGHT BY TEACHERS HOLDING A
CERTIFICATE TO TEACH HEALTH. THE DEPARTMENT SHALL REPORT TO THE LEGISLA-
TURE BIENNIALLY EVALUATING THE IMPLEMENTATION OF THIS SUBDIVISION.
  S 3. This act shall take effect immediately.
