AN ACT to amend the general municipal  law,  in  relation  to  residency
  agreements  as  a condition of employment for police officers or fire-
  fighters

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  general  municipal  law  is  amended by adding a new
section 208-h to read as follows:
  S 208-H. PROHIBITION ON RESIDENCY AGREEMENTS AS CONDITION  OF  EMPLOY-
MENT WITH POLICE OR FIRE DEPARTMENT. NOTWITHSTANDING ANY OTHER PROVISION
OF LAW, NO MUNICIPAL CORPORATION SHALL REQUIRE, AS A CONDITION PRECEDENT
TO  EMPLOYMENT  OR  CONSIDERATION FOR EMPLOYMENT WITH ITS POLICE OR FIRE
DEPARTMENT, ANY INDIVIDUAL TO  ENTER  INTO  OR  SIGN  AN  AGREEMENT  FOR
CONTRACTUAL DEBT, OR OBLIGE ANY INDIVIDUAL IN THE EMPLOY OF SUCH MUNICI-
PAL  CORPORATION  TO  PAY  ANY  TAX, FEE, OR WAGE REDUCTION, SHOULD SUCH
INDIVIDUAL BE OR BECOME A NON-RESIDENT OF  SUCH  MUNICIPAL  CORPORATION.
FOR  THE PURPOSES OF THIS SECTION, THE TERM "NON-RESIDENT" SHALL MEAN AN
INDIVIDUAL WHO IS NOT DOMICILED  WITHIN  THE  LIMITS  OF  THE  EMPLOYING
MUNICIPAL  CORPORATION  AND  MAINTAINS  A PERMANENT PLACE OF ABODE ELSE-
WHERE. ANY RESIDENCY AGREEMENT ENTERED INTO OR SIGNED BY AN EMPLOYEE  OF
THE  POLICE  OR  FIRE DEPARTMENT OF A MUNICIPAL CORPORATION PRIOR TO THE
EFFECTIVE DATE OF THIS SECTION SHALL BE VOID.
  S 2. This act shall take effect on the first of July  next  succeeding
the date on which it shall have become a law.
