AN ACT to amend the social services law, in relation  to  state  funding
  for children and family services

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (b) of subdivision 2  of  section  153-k  of  the
social  services  law, as added by section 15 of part C of chapter 83 of
the laws of 2002, is amend to read as follows:
  (b) State reimbursement to each  social  services  district  shall  be
limited to the district's allocation of the foster care block grant. The
state funds appropriated for the foster care block grant shall be appor-
tioned among the social services districts by the office of children and
family  services  based  on  the  district's  claiming history and other
factors. Such apportionments shall be subject to  the  approval  of  the
director  of  the budget. NOTWITHSTANDING THE PROVISIONS OF THIS CHAPTER
OR OF ANY OTHER PROVISION OF LAW TO THE CONTRARY,  ANY  SOCIAL  SERVICES
DISTRICT WHICH RECEIVES FUNDS PURSUANT TO THIS SUBDIVISION SHALL PAY ALL
AUTHORIZED AGENCIES WITH WHICH IT CONTRACTS FOR FOSTER CARE THE STANDARD
OF PAYMENT ISSUED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES PURSUANT
TO  SECTION  THREE  HUNDRED  NINETY-EIGHT-A  OF  THIS  CHAPTER.   SOCIAL
SERVICES DISTRICTS AND SUCH AGENCIES MAY NEGOTIATE  A  HIGHER  RATE  FOR
ADDITIONAL  SERVICES PROVIDED THAT ANY PAYMENT IN EXCESS OF THE STANDARD
OF PAYMENT SHALL NOT BE SUBJECT TO REIMBURSEMENT PURSUANT  TO    SECTION
THREE HUNDRED NINETY-EIGHT-A OF THIS CHAPTER.
  S  2. This act shall take effect immediately, provided that the amend-
ments to paragraph (b) of subdivision 2 of section 153-k of  the  social
services  law,  made  by  section  one of this act, shall not affect the
expiration and repeal of such section and shall  expire  and  be  deemed
repealed therewith.
