AN ACT to repeal section 396-ff of the general business law, relating to
  eliminating the pistol and revolver ballistic identification databank

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Legislative  findings  and intent. The legislature hereby
finds that the Combined  Ballistic  Identification  System  has  had  no
success  in  New York State while costing the state four million dollars
to initially implement the system and an estimated four million  dollars
annually  to  maintain,  at an average cost of approximately two hundred
dollars per legal gun. The system does not save time or assist  forensic
investigators  in  accomplishing  their  job.  As of August 1, 2004, the
system has collected and imaged approximately 77,194 handguns, register-
ing zero hits on gun crimes.   Additionally,  the  system  is  routinely
bypassed due to known flaws.
  Considering the lack of success of the system and the associated cost,
it is the intent of the legislature to abolish the system.
  S 2. Section 396-ff of the general business law is REPEALED.
  S 3. This act shall take effect on the one hundred twentieth day after
it shall have become a law.
