AN ACT to amend the general obligations law, in  relation  to  requiring
  that  all  bridge  ways,  walkways,  and  overpasses  built for safety
  purposes during construction are required to be  salted  and  shoveled
  when there is snow or ice

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general obligations law is  amended  by  adding  a  new
section 5-322.4 to read as follows:
  S 5-322.4. BRIDGE WAYS, WALKWAYS AND OVERPASSES TO BE SALTED AND SHOV-
ELED.   EVERY WRITTEN CONTRACT OR AGREEMENT EXECUTED BY AN OWNER PROVID-
ING FOR THE BUILDING, CONSTRUCTION, REPAIR OR RENOVATION  OF  BUILDINGS,
STRUCTURES,  OR  IMPROVEMENTS  UPON  REAL  PROPERTY  OWNED  BY HIM OR IT
INCLUDING CONTRACTS INVOLVING PUBLIC IMPROVEMENTS AND CONTRACTS  INVOLV-
ING RESIDENTIAL PROPERTY, SHALL CONTAIN A CLAUSE REQUIRING SUCH OWNER TO
SET  FORTH  IN  SAID  CONTRACT THAT ALL BRIDGE WAYS, WALKWAYS, AND OVER-
PASSES BUILT FOR SAFETY PURPOSES DURING CONSTRUCTION ARE REQUIRED TO  BE
SALTED AND SHOVELED WHEN SNOW OR ICE APPEARS.
  S 2. This act shall take effect immediately.
