AN ACT to amend the  environmental  conservation  law,  in  relation  to
  providing  that  local and state fairs, shopping centers and amusement
  parks must provide recycling containers and be  part  of  a  recycling
  program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 27 of the environmental conservation law is amended
by adding a new title 18 to read as follows:
                                 TITLE 18
                           MANDATORY RECYCLING
SECTION 27-1801. RECYCLING FOR FAIRS,  SHOPPING  CENTERS  AND  AMUSEMENT
                   PARKS REQUIRED.
S 27-1801. RECYCLING  FOR  FAIRS,  SHOPPING  CENTERS AND AMUSEMENT PARKS
             REQUIRED.
  1. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE  CONTRARY,
ALL  LOCAL  AND  STATE FAIRS, SHOPPING CENTERS CONTAINING MORE THAN FIVE
STORES AND AMUSEMENT PARKS MUST PROVIDE RECYCLING CONTAINERS  AT  APPRO-
PRIATE  LOCATIONS  ON  THE  PREMISES OF SUCH FAIRS, SHOPPING CENTERS AND
AMUSEMENT PARKS.
  2. ALL RECYCLING CONTAINERS SHALL BE APPROPRIATELY LABELED.
  3. ALL SUCH FAIRS, SHOPPING CENTERS AND AMUSEMENT PARKS SHALL  PARTIC-
IPATE  IN  A RECYCLING PROGRAM IF SUCH PROGRAM IS OFFERED BY THE MUNICI-
PALITY IN WHICH SUCH FAIR, SHOPPING CENTER OR AMUSEMENT PARK IS LOCATED.
  S 2. This act shall take effect immediately.
