AN ACT to amend the public health law, in relation to the development of
  a nutrition and fitness website by the department of health

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  1 of section 201 of the public health law is
amended by adding a new paragraph (t) to read as follows:
  (T) DEVELOP, IN CONJUNCTION WITH THE DEPARTMENT OF EDUCATION, THE  NEW
YORK STATE PARENT TEACHERS ASSOCIATION AND ANY OTHER SCHOOL ORGANIZATION
THAT  THE  DEPARTMENT DEEMS RELEVANT, A NUTRITION AND FITNESS WEBSITE TO
PROVIDE DAY CARE PROVIDERS AND PARENTS  WITH  INFORMATION  AVAILABLE  TO
FIGHT CHILDHOOD OBESITY INCLUDING, BUT NOT LIMITED TO, PORTION SIZES AND
THE  RECOMMENDED  NUMBER  OF  SERVINGS FOR THE DIFFERENT FOOD GROUPS PER
DAY. ADDITIONALLY, THE FOLLOWING INFORMATION SHALL BE PROVIDED  AS  PART
OF  THE  WEBSITE:  NUTRITIONAL GUIDELINES (AS FOUND ON THE UNITED STATES
DEPARTMENT  OF  AGRICULTURE  WEBSITE);  SAMPLE  MENUS  TO   OFFER   MENU
SUGGESTIONS  BASED ON THE NUTRITIONAL GUIDELINES, AS WELL AS ALTERNATIVE
MENUS FOR CHILDREN WITH ALLERGIES OR HEALTH PROBLEMS;  EXAMPLES  OF  AGE
APPROPRIATE  PHYSICAL  ACTIVITIES;  AND  UPDATED  INFORMATION  REGARDING
NUTRITION AND OBESITY ISSUES. ALL SUCH INFORMATION SHALL BE PROVIDED FOR
FREE TO THE PUBLIC, AND SHALL BE LINKED TO THE DEPARTMENT'S WEBSITE.  IN
ADDITION, THE OFFICE OF CHILDREN AND  FAMILY  SERVICES  SHALL  MAKE  ANY
CHILD DAY CARE LICENSE APPLICANT OR RE-APPLICANT AWARE OF THE AVAILABIL-
ITY  OF SUCH INFORMATION ON THE DEPARTMENT'S WEBSITE BY PROVIDING A LINK
TO SUCH INFORMATION FROM THE OFFICE OF  CHILDREN  AND  FAMILY  SERVICES'
WEBSITE  AS  WELL  AS PROVIDING AN INFORMATIONAL BROCHURE OR A CLAUSE IN
THE APPLICATION ITSELF;
