2009-A5688 (ACTIVE) - Summary

Establishes upon a showing that a school district is unable to expend the maximum allocation that such district would be eligible to receive for costs associated with providing universal prekindergarten in any school year, the commissioner shall be authorized to grant a waiver to allow such school district to expend grant funds for expenses incurred for the provision of full-day prekindergarten programs, after-school educational programs in grades kindergarten through two or other programs and activities approved by the commissioner that are designed to improve student academic performance in prekindergarten through grade two.

AN  ACT  to  amend  the  education law, in relation to the use of monies
  received for costs associated with providing universal prekindergarten

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  10 of section 3602-e of the education law is
amended by adding a new paragraph d to read as follows:
  D. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, UPON  A
SHOWING  THAT  A  SCHOOL  DISTRICT IN UNABLE TO EXPEND THE MAXIMUM ALLO-
CATION THAT SUCH DISTRICT WOULD BE ELIGIBLE TO RECEIVE FOR COSTS ASSOCI-
ATED WITH PROVIDING UNIVERSAL PREKINDERGARTEN IN ANY  SCHOOL  YEAR,  THE
COMMISSIONER  SHALL  BE AUTHORIZED TO GRANT A WAIVER FROM ANY LAW TO THE
CONTRARY TO ALLOW  SUCH  SCHOOL  DISTRICT  TO  EXPEND  GRANT  FUNDS  FOR
EXPENSES   INCURRED   FOR  THE  PROVISION  OF  FULL-DAY  PREKINDERGARTEN
PROGRAMS,  AFTER-SCHOOL  EDUCATIONAL  PROGRAMS  IN  GRADES  KINDERGARTEN
THROUGH TWO OR OTHER PROGRAMS AND ACTIVITIES APPROVED BY THE COMMISSION-
ER  THAT ARE DESIGNED TO IMPROVE STUDENT ACADEMIC PERFORMANCE IN PREKIN-
DERGARTEN THROUGH GRADE TWO. EXPENDITURES MADE PURSUANT TO  SUCH  WAIVER
SHALL BE DEEMED ALLOWABLE GRANT EXPENDITURES FOR ALL PURPOSES UNDER THIS
SECTION.
  S  2.  This  act  shall take effect immediately and shall be deemed to
have been in full force and effect for the 2010-2011 school year.
