2009-A5725 (ACTIVE) - Summary

Limits the current exemption from open meetings law provisions that is applicable to the deliberations of political committees, conferences and caucuses by amending the definition of deliberations of political committees, conferences and caucuses to the effect that in order to be exempt the deliberations (in a private meeting, of the members of the state senate or assembly or of the legislative body of a county, city, town or village, who are members or adherents of the same political party) must occur during the period of discussion of matters of political party business, including the development of political party policy on issues of public business.

AN ACT to amend the public officers law, in relation to deliberations of
  political committees, conferences and caucuses

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph b of subdivision 2 of section 108 of the public
officers law, as amended by chapter 136 of the laws of 1985, is  amended
to read as follows:
  b.  for  purposes  of  this  section,  the  deliberations of political
committees, conferences and caucuses means a private meeting of  members
of  the  senate or assembly of the state of New York, or of the legisla-
tive body of a county, city, town or village, who are members or  adher-
ents  of  the  same  political party, DURING THE PERIOD OF DISCUSSION OF
MATTERS OF POLITICAL PARTY BUSINESS, INCLUDING THE DEVELOPMENT OF  POLI-
TICAL  PARTY  POLICY ON ISSUES OF PUBLIC BUSINESS, without regard to (i)
[the subject matter under discussion, including  discussions  of  public
business,  (ii)]  the  majority  or  minority  status  of such political
committees, conferences and caucuses or [(iii)] (II) whether such  poli-
tical  committees,  conferences  and  caucuses invite staff or guests to
participate in their deliberations; and
  S 2. This act shall take effect on the thirtieth day  after  it  shall
have become a law.
