AN ACT to direct the department of audit and control to study  and  make
  recommendations on the establishment and operation of a public retire-
  ment  system  for  the  benefit  of  employees of private providers of
  mental hygiene services

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The department of audit and control shall examine, evaluate
and  make recommendations on the establishment and operation of a public
retirement system, similar to the New York state  and  local  employees'
retirement  system,  and  subject  to the control and supervision of the
state comptroller, for the benefit of the employees of each provider  of
services  issued an operating certificate pursuant to the mental hygiene
law. Such department shall direct its attention to at least the  follow-
ing:
  (a) the contributions by employees and the providers of services which
would be necessary to operate such public retirement system;
  (b) the pension benefits that would be payable to employees;
  (c) the costs of operating such a public retirement system; and
  (d)  the legislation, rules and regulations necessary to establish and
implement such a public retirement system.
  S 2. The department of audit and control shall hold such public  hear-
ings  as  shall  be  necessary  to  fulfill  its duties pursuant to this
section.
  S 3. The department of audit and  control  shall  make  a  preliminary
report  to the governor and the legislature of its findings, conclusions
and recommendations on or before April 1, 2010, and a  final  report  of
its  findings,  conclusions  and  recommendations  on or before April 1,
