AN ACT to amend the penal law, in relation to endangering the welfare of
  a child by committing a physical assault in such child's presence

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 260.10 of the penal law is  renum-
bered  subdivision  4 and two new subdivisions 2 and 3 are added to read
as follows:
  2. WITH INTENT TO CAUSE PHYSICAL INJURY TO A MEMBER OF THE SAME FAMILY
OR HOUSEHOLD, AS DEFINED IN SECTION 530.11  OF  THE  CRIMINAL  PROCEDURE
LAW,  HE  OR  SHE CAUSES SUCH INJURY TO SUCH PERSON IN THE PRESENCE OF A
CHILD LESS THAN SEVENTEEN YEARS OLD; OR
  3. HE OR SHE RECKLESSLY CAUSES PHYSICAL INJURY TO A MEMBER OF THE SAME
FAMILY OR HOUSEHOLD, AS DEFINED BY SECTION 530.11 OF THE CRIMINAL PROCE-
DURE LAW, IN THE PRESENCE OF A CHILD LESS THAN SEVENTEEN YEARS OLD; OR
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
