2009-A6146 (ACTIVE) - Summary

Provides that under a child protective order a judge may order the parent or guardian of such child to participate in family counseling if necessary for the child, provided that such counseling is not contrary to the health, safety or welfare of the child and the person's religious beliefs.

  MOLINARO, OAKS, SAYWARD, SEMINERIO, TOWNSEND, WEISENBERG -- read  once
  and referred to the Committee on Judiciary

AN  ACT  to  amend  the  family  court  act,  in  relation  to orders of
  protection in abuse and neglect cases

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (h) of subdivision 1 of section 1056 of the fami-
ly  court  act,  as  relettered  by  chapter 253 of the laws of 2006, is
relettered paragraph (i) and a new paragraph (h) is  added  to  read  as
follows:
  (H)  TO  PARTICIPATE  IN FAMILY COUNSELING OR OTHER PROFESSIONAL COUN-
SELING ACTIVITIES CONDUCTED BY AN AUTHORIZED  PERSON  OR  AN  AUTHORIZED
AGENCY  TO  WHICH  THE  CHILD HAS BEEN REFERRED OR PLACED, PROVIDED THAT
SUCH FAMILY COUNSELING OR  OTHER  COUNSELING  IS  NOT  CONTRARY  TO  THE
HEALTH,  SAFETY  OR  WELFARE  OF  THE  CHILD AND SUCH PERSON'S RELIGIOUS
BELIEFS;
  S 2. This act shall take effect immediately.
