AN ACT to amend the public health  law,  in  relation  to  reimbursement
  rates for inpatient hospital services at the Nassau university medical
  center

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Clause (C) of subparagraph (iii) of paragraph (b) of subdi-
vision 5 of section 2807-c of the public health law is amended by adding
a new item (IV) to read as follows:
  (IV) IN ORDER TO ADEQUATELY REIMBURSE NASSAU UNIVERSITY MEDICAL CENTER
FOR THE SAFETY-NET SERVICES IT PROVIDES TO THE RESIDENTS OF  THE  COUNTY
OF  NASSAU,  AND  TO REFLECT ITS STATUS AS A FREE-STANDING HOSPITAL, FOR
DISCHARGES ON OR AFTER JANUARY FIRST, TWO THOUSAND NINE, THE  REIMBURSA-
BLE  INPATIENT  OPERATING  COST  PER DISCHARGE FOR THE NASSAU UNIVERSITY
MEDICAL CENTER SHALL BE COMPUTED BASED ON ONE  HUNDRED  PERCENT  OF  THE
GROUP  AVERAGE  OF  THE  MAJOR PUBLIC HOSPITAL GROUP, IN ACCORDANCE WITH
SECTION 86-1.72(A) OF THE REGULATIONS OF THE DEPARTMENT, COMPUTED  USING
THE  COST DATA RELATED TO ALL MEMBERS OF THE MAJOR PUBLIC HOSPITAL GROUP
OTHER THAN THE NASSAU UNIVERSITY MEDICAL CENTER OR ITS PREDECESSORS, THE
COUNTY OF NASSAU AND/OR THE NASSAU COUNTY MEDICAL CENTER.
  S 2. This act shall take effect immediately, provided that the  amend-
ments  to  clause (C) of subparagraph (iii) of paragraph (b) of subdivi-
sion 5 of section 2807-c of the public health law, made by  section  one
of  this  act,  shall not affect the expiration of such subparagraph and
shall expire therewith.
