AN ACT to amend the banking law, in relation to requiring certain  secu-
  rity measures at all automated teller machine facilities

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 75-b of the banking law, as  added
by chapter 9 of the laws of 1996, is amended to read as follows:
  3.  "Automated  teller  machine  facility"  means  an area [within the
dominion and control of a banking institution] comprised of one or  more
automated  teller  machines and any adjacent space [which is made avail-
able to banking customers after regular banking hours].
  S 2. The opening paragraph of section 75-c  of  the  banking  law,  as
added by chapter 9 of the laws of 1996, is amended to read as follows:
  Every  banking institution shall maintain the following security meas-
ures with respect to each of the  automated  teller  machine  facilities
[within its dominion and control] IT OWNS OR OPERATES:
  S  3.  The  opening  paragraph of subdivision 3 of section 75-c of the
banking law, as added by chapter 9 of the laws of 1996,  is  amended  to
read as follows:
  With respect to an indoor automated teller machine facility WITHIN THE
DOMINION AND CONTROL OF SUCH BANKING INSTITUTION:
  S 4. This act shall take effect on the one hundred twentieth day after
it shall have become a law.
