2009-A6212 (ACTIVE) - Summary

Authorizes a one-time emergency payment to an individual or a family who otherwise would become eligible for ongoing public assistance to aid in acquiring or maintaining employment; and provides that such payment, unless approved by local social services commissioner, shall not exceed the maximum monthly allowance available under the home relief or aid for dependent children programs.

AN ACT to amend the social services  law,  in  relation  to  authorizing
  one-time  emergency payments to certain persons to aid in acquiring or
  maintaining employment

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 131 of the social services law is amended by adding
a new subdivision 1-a to read as follows:
  1-A.  NOTWITHSTANDING  ANY  PROVISIONS  OF  LAW TO THE CONTRARY, LOCAL
SOCIAL SERVICES OFFICIALS SHALL BE AUTHORIZED, IN ACCORDANCE WITH  REGU-
LATIONS  ESTABLISHED  BY  THE DEPARTMENT OF LABOR, TO PROVIDE A ONE-TIME
EMERGENCY PAYMENT TO MEET THE IMMEDIATE NEEDS OF AN INDIVIDUAL OR  FAMI-
LY,  WHO  WOULD OTHERWISE BECOME ELIGIBLE FOR ONGOING PUBLIC ASSISTANCE,
IN ORDER TO AID THE INDIVIDUAL OR FAMILY  IN  ACQUIRING  OR  MAINTAINING
EMPLOYMENT.  INDIVIDUALS  OR  FAMILIES RECEIVING SUCH ONE-TIME EMERGENCY
PAYMENT FOR THE PURPOSE OF ACQUIRING OR MAINTAINING EMPLOYMENT SHALL  BE
REQUIRED  TO  SIGN  A  REPAYMENT  AGREEMENT  TO REPAY THE ASSISTANCE, IN
ACCORDANCE WITH REGULATIONS ESTABLISHED BY THE DEPARTMENT OF LABOR.   IN
NO  EVENT  SHALL SUCH ONE-TIME PAYMENT EXCEED THE MAXIMUM MONTHLY ALLOW-
ANCE THAT WOULD OTHERWISE BE GRANTED TO AN INDIVIDUAL OR FAMILY  OF  THE
SAME  SIZE UNDER THE SAFETY NET ASSISTANCE, VETERAN ASSISTANCE OR FAMILY
ASSISTANCE PROGRAMS, UNLESS A PAYMENT EXCEEDING THIS  AMOUNT  IS  DETER-
MINED BY THE LOCAL COMMISSIONER TO BE APPROPRIATE TO ACCOMPLISH THE GOAL
OF MAINTAINING THE INDIVIDUAL'S OR FAMILY'S SELF-SUFFICIENCY.
  S 2. This act shall take effect on the one hundred eightieth day after
it  shall  have become a law; provided, however, that any rules or regu-
lations necessary for the timely implementation  of  the  provisions  of
this  act  are authorized and directed to be completed on or before such
effective date.
