AN ACT to amend the education law, in relation to  requiring  minors  to
  attain the age of five years before entering kindergarten

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section  3205  of  the  education  law  is
amended by adding a new paragraph d to read as follows:
  D.  NO MINOR SHALL ENTER KINDERGARTEN ON THE FIRST DAY THAT THE APPRO-
PRIATE PUBLIC SCHOOLS ARE IN SESSION IN SEPTEMBER  OF  THE  SCHOOL  YEAR
UNLESS  SUCH  MINOR  HAS  ATTAINED  THE AGE OF FIVE YEARS OR OLDER ON OR
BEFORE THE FIRST DAY OF SEPTEMBER OF SUCH SCHOOL YEAR.
  S 2. This act shall take effect on the first of July  next  succeeding
the  date  on  which  it  shall have become a law and shall apply to all
minors entering kindergarten after such date.
