AN ACT to amend the executive law, in relation to  notification  to  the
  legislature  regarding  applications  to state agencies for grants and
  financing by tax exempt bonds

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The executive law is amended by adding a new section 170-b
to read as follows:
  S 170-B. NOTIFICATION TO LEGISLATURE; GRANTS AND TAX EXEMPT BONDS.  1.
FOR PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOW-
ING MEANINGS:
  (A)  "STATE  AGENCY" SHALL MEAN ANY DEPARTMENT, BOARD, BUREAU, COMMIS-
SION, DIVISION, OFFICE, COUNCIL, COMMITTEE OR OFFICER OF  THE  STATE,  A
PUBLIC  BENEFIT  CORPORATION  OR PUBLIC AUTHORITY, AT LEAST ONE OF WHOSE
MEMBERS IS APPOINTED BY THE GOVERNOR.
  (B) "PERSON" SHALL  MEAN  ANY  INDIVIDUAL,  CORPORATION,  PARTNERSHIP,
LIMITED  LIABILITY  COMPANY, ASSOCIATION, TRUSTEE, MUNICIPALITY OR OTHER
LEGAL ENTITY, BUT SHALL NOT INCLUDE THE STATE OR ANY STATE AGENCY.
  2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO APPLICATION  TO  ANY
STATE  AGENCY  BY  A  PERSON  FOR  ANY GRANT OR FOR THE FINANCING OF ANY
PROJECT BY THE ISSUANCE OF BONDS WHICH ARE EXEMPT FROM TAXATION SHALL BE
APPROVED WITHOUT RECEIPT BY SUCH AGENCY THAT THE APPLICANT HAS  PROVIDED
THE  TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE
MINORITY LEADER OF THE SENATE, THE MINORITY LEADER OF THE  ASSEMBLY  AND
THE SENATOR AND MEMBER OF THE ASSEMBLY WHO REPRESENT THE SENATE DISTRICT
AND  ASSEMBLY  DISTRICT  WHERE  SUCH  PROJECT  IS  LOCATED, WITH WRITTEN
NOTIFICATION STATING THAT SUCH APPLICATION HAS BEEN MADE TO SUCH  AGENCY
AND SETTING FORTH THE AMOUNT OF SUCH GRANT OR FINANCING.  THE CONTENT OF
SUCH  NOTIFICATION,  AND  THE MANNER AND FORM IN WHICH SUCH NOTIFICATION
SHALL BE MADE SHALL BE DETERMINED BY THE LEGISLATURE.
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have become a law.
