AN ACT to amend the public health law, in relation to prohibiting  smok-
  ing in vehicles in which there is a minor

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivisions 17 and 18 of  section  1399-o  of  the  public
health  law,  as  amended by chapter 13 of the laws of 2003, are amended
and a new subdivision 19 is added to read as follows:
  17. zoos; [and]
  18. bingo facilities[.]; AND
  19. IN A MOTOR VEHICLE, WHETHER IN MOTION OR AT REST, IN  WHICH  THERE
IS  A MINOR; PROVIDED THAT A MOTOR VEHICLE SHALL BE CONSIDERED AN INDOOR
AREA FOR THE PURPOSES OF THIS SUBDIVISION,  REGARDLESS  OF  WHETHER  THE
WINDOWS ARE OPEN OR CLOSED.
  S 2. This act shall take effect immediately.
