AN ACT to amend the executive law, in relation to menus for the visually
  impaired

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of  section  296  of  the  executive  law  is
amended by adding a new paragraph (f) to read as follows:
  (F)  (1)  FOR  THE PURPOSES OF COMPLIANCE WITH THE PROVISIONS OF PARA-
GRAPH (A) OF THIS SUBDIVISION INSOFAR AS  THEY  PROHIBIT  DISCRIMINATION
AGAINST THE VISUALLY IMPAIRED BY RESTAURANTS, THE OFFERING, UPON REQUEST
THEREFOR, OF A CURRENT MENU PRINTED IN NOT LESS THAN EIGHTEEN POINT BOLD
FONT  TYPE USING A PAPER AND INK COLOR COMBINATION PROVIDING CONTRAST BY
MEANS OF, OR SUBSTANTIALLY EQUIVALENT TO THAT OF,  BLACK  INK  ON  WHITE
PAPER  SHALL  BE  DEEMED  TO CONSTITUTE COMPLIANCE.   IN LIEU THEREOF, A
PHOTOCOPIED ENLARGEMENT OF THE MENU, RENDERING THE PRINT TO APPROXIMATE-
LY EIGHTEEN POINTS, MAY BE USED. THE PROVISIONS OF THIS PARAGRAPH  SHALL
NOT BE CONSTRUED TO APPLY TO DAILY SPECIALS.
  (2)  FOR THE PURPOSES OF THIS PARAGRAPH, THE TERM "RESTAURANT" MEANS A
PLACE WHERE FOOD IS SOLD FOR CONSUMPTION ON THE  PREMISES,  WHICH  PLACE
OCCUPIES  FIXED  PREMISES  AND  OFFERS  FIXED  AND ENCLOSED PREMISES FOR
DINING.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
