AN ACT to amend the civil practice law and rules, in relation to obtain-
  ing disclosure from a non-party witness

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph 4 of subdivision (a) of section 3101 of the civil
practice law and rules, as amended by chapter 98 of the laws of 1993, is
amended to read as follows:
  (4) any other person, upon notice stating the circumstances or reasons
such disclosure is sought or required, AND WITHOUT THE  NEED  TO  DEMON-
STRATE SPECIAL CIRCUMSTANCES, SUBJECT TO THE PROVISIONS OF SECTION THIR-
TY-ONE HUNDRED THREE OF THIS ARTICLE, WHERE APPLICABLE.
  S  2.  This  act  shall take effect immediately and shall apply to all
actions pending on or commenced after such date.
