KAVANAGH -- read once and referred to the Commit- tee on Ways and Means AN ACT to amend the state finance law, in relation to requiring specif- ically itemized appropriations to ensure accountability THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 43 of the state finance law, as amended by chapter 169 of the laws of 1994, the second undesignated paragraph as amended by chapter 137 of the laws of 2008, is amended to read as follows: S 43. Specific appropriations limited as to use; certain appropri- ations to be specific. 1. Money appropriated for a specific purpose shall not be used for any other purpose, and the comptroller shall not draw a warrant for the payment of any sum appropriated, unless it clear- ly appears from the detailed statement presented to him by the person demanding the same as required by this chapter, that the purposes for which such money is demanded are those for which it was appropriated. The comptroller shall not audit any claim for salary, labor or wages, unless an appropriation applicable thereto has been already made speci- fying the amount thereof appropriated for such purpose. 2. Except as otherwise expressly provided, the comptroller shall not audit any claim or account or draw a warrant for the payment of moneys for the purchase of an aircraft intended primarily for the purpose of carrying passengers or the rent of an aircraft for such purpose for a period longer than ten days. The provision of this section shall not apply to the necessary rental of automobiles for construction and main- tenance work on the highways of the state or for grade crossing elimi- nation work. 3. ALL APPROPRIATIONS AND REAPPROPRIATIONS SHALL BE SPECIFICALLY ITEM- IZED AND DETAILED TO DEMONSTRATE THE PURPOSE OF SUCH APPROPRIATION, INCLUDING THE REVENUE SOURCE OF SUCH APPROPRIATION, AND TO ENSURE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
