BALL -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to legal status of employees under state contracts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 315-a to read as follows: S 315-A. LEGAL STATUS OF EMPLOYEES. ALL STATE CONTRACTS BETWEEN A STATE AGENCY AND A CONTRACTOR SHALL CONTAIN A PROVISION PROVIDING THAT THE CONTRACTORS OR ANY SUBCONTRACTORS THEREOF SHALL EMPLOY ONLY PERSONS WHO ARE UNITED STATES CITIZENS OR ARE LEGALLY ENTITLED TO REMAIN IN THE UNITED STATES. SUCH CONTRACTORS AND SUBCONTRACTORS SHALL USE BASIC EMPLOYMENT VERIFICATION TO ENSURE COMPLIANCE WITH THIS SECTION. S 2. This act shall take effect immediately; provided, however, that the amendments to article 15-A of the executive law made by section one of this act shall not affect the expiration of such article and shall be deemed expired therewith.
