AN ACT to amend the executive law, in relation to the  state  office  of
  homeland security; and making an appropriation therefor

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The executive law is amended by adding a new section 716 to
read as follows:
  S 716. MEMORANDUMS OF AGREEMENT AND  GRANTS.  1.  THE  DIRECTOR  SHALL
COORDINATE  MEMORANDUMS OF AGREEMENT BETWEEN THE SECRETARY OF THE UNITED
STATES DEPARTMENT OF HOMELAND SECURITY AND STATE AND LOCAL LAW  ENFORCE-
MENT  AGENCIES,  INCLUDING  BUT  NOT  LIMITED  TO  THE DIVISION OF STATE
POLICE, PERMITTING DESIGNATED POLICE OFFICERS TO PERFORM IMMIGRATION LAW
ENFORCEMENT FUNCTIONS IN  ACCORDANCE  WITH  THE  PROVISIONS  OF  SECTION
287(G) OF THE FEDERAL ILLEGAL IMMIGRATION REFORM AND IMMIGRANT RESPONSI-
BILITY ACT (IIRAIRA).
  2.  NOTWITHSTANDING  ANY  OTHER  PROVISION  OF  LAW AND SUBJECT TO THE
AVAILABILITY OF AN APPROPRIATION,  THE  DIRECTOR  SHALL  ADMINISTER  AND
DISTRIBUTE  GRANTS TO INTERESTED LOCAL LAW ENFORCEMENT AGENCIES IN ORDER
THAT THEIR POLICE OFFICERS ARE ABLE TO RECEIVE APPROPRIATE TRAINING  AND
FUNCTION  UNDER  THE  SUPERVISION  OF SWORN U.S. IMMIGRATION AND CUSTOMS
ENFORCEMENT OFFICERS ACCORDING TO THE PROVISIONS OF  SECTION  287(G)  OF
IIRAIRA.   THE DIRECTOR SHALL PROMULGATE ALL APPROPRIATE RULES AND REGU-
LATIONS PERTAINING TO APPLICATIONS FOR AND AWARDS OF SUCH GRANTS.
  S 2. The sum of one million dollars ($1,000,000), or so  much  thereof
as  may be necessary is hereby appropriated to the state office of home-
land security out of any moneys in the state  treasury  in  the  general
fund to the credit of the state purposes account not otherwise appropri-
ated, for its expenses, including personal service maintenance and oper-
ation,  in  carrying  out the provisions of this act. All funds shall be
paid on vouchers approved by the director  of  the  office  of  homeland
security.
  S 3. This act shall take effect immediately.
