2009-A6979 (ACTIVE) - Summary
Increases the period of license suspension for driving while intoxicated and driving while ability impaired offenses to one year; requires mandatory attendance at an alcohol rehabilitation program for such offenses; provides that a second offense shall result in a two year suspension; provides for an additional six month suspension when a child of less than thirteen years of age was a passenger in such vehicle.

SALADINO -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to increasing the period of license suspension for certain DWI offenses and requir- ing attendance at an alcohol and drug rehabilitation program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraphs 2 and 3 of paragraph (b) of subdivision 2 of section 1193 of the vehicle and traffic law, as amended by chapter 732 of the laws of 2006, are amended to read as follows: (2) Driving while intoxicated or while ability impaired by drugs or while ability impaired by the combined influence of drugs or of alcohol and any drug or drugs; aggravated driving while intoxicated. [Six months] (A) ONE YEAR, where the holder is convicted of a violation of subdivision two, TWO-A, three, four or four-a of section eleven hundred ninety-two of this article. (B) One year AND SIX MONTHS, where the holder is convicted of a violation of subdivision TWO, two-a, THREE, FOUR OR FOUR-A of section eleven hundred ninety-two of this article AND A CHILD OF LESS THAN THIR- TEEN YEARS OF AGE WAS A PASSENGER OF THE VEHICLE AT THE TIME OF SUCH OFFENSE. (3) Driving while intoxicated or while ability impaired by drugs or while ability impaired by the combined influence of drugs or of alcohol and any drug or drugs; aggravated driving while intoxicated; prior offense. [One year] (A) TWO YEARS, where the holder is convicted of a violation of subdivision two, TWO-A, three, four or four-a of section eleven hundred ninety-two of this article committed within ten years of a conviction for a violation of subdivision two, TWO-A, three, four or four-a of section eleven hundred ninety-two of this article. [Eighteen months] (B) TWO YEARS AND SIX MONTHS, where the holder is convicted of a violation of subdivision TWO, two-a, THREE, FOUR OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
