AN ACT to amend the state finance law, in relation to  establishing  and
  funding the trauma center fund

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The state finance law is amended by adding  a  new  section
95-h to read as follows:
  S  95-H.  THE  NEW YORK STATE "TRAUMA CENTER FUND". 1. THERE IS HEREBY
ESTABLISHED IN THE JOINT CUSTODY OF THE  COMMISSIONER  OF  TAXATION  AND
FINANCE  AND  THE COMPTROLLER A SPECIAL FUND TO BE KNOWN AS THE NEW YORK
STATE "TRAUMA CENTER FUND".
  2. THE SUM OF FOUR MILLION DOLLARS ($4,000,000), OR SO MUCH THEREOF AS
MAY BE NECESSARY, IS HEREBY APPROPRIATED TO THE DEPARTMENT  OF  TAXATION
AND  FINANCE OUT OF ANY MONEYS IN THE STATE TREASURY IN THE GENERAL FUND
TO THE CREDIT OF THIS FUND NOT OTHERWISE APPROPRIATED, FOR ITS EXPENSES,
INCLUDING PERSONAL SERVICE, MAINTENANCE AND OPERATION, IN  CARRYING  OUT
THE  PROVISIONS OF THIS SECTION. NOTHING CONTAINED IN THIS SECTION SHALL
PREVENT THE STATE FROM RECEIVING  GRANTS,  GIFTS  OR  BEQUESTS  FOR  THE
PURPOSE  OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM INTO
THE FUND ACCORDING TO LAW.
  3. (A) MONIES OF THE FUND SHALL BE EXPENDED FOR ADMINISTRATION, TRAIN-
ING AND INFORMATION  TECHNOLOGIES  FOR  EMERGENCY  MEDICAL,  TRAUMA  AND
DISASTER  CARE  IN TRAUMA CENTERS LOCATED IN GENERAL HOSPITALS AND OTHER
HEALTH CARE FACILITIES ACCREDITED BY THE STATE OF NEW YORK  PURSUANT  TO
THE PUBLIC HEALTH LAW.
  (B)  AS  USED IN THIS SECTION "TRAUMA CENTER" MEANS A FACILITY CAPABLE
OF PROVIDING DEFINITIVE TRAUMA CARE.
  (C) AS USED IN THIS SECTION "TRAUMA CARE" MEANS HEALTH  CARE  PROVIDED
TO PATIENTS AT HIGH RISK OF DEATH OR DISABILITY FROM MULTIPLE AND SEVERE
INJURIES.
