Provides that the education commissioner may make grants to school districts which have incurred costs in the removal, replacement or sealing of wood or wood products, which have been treated with chromated copper arsenate and were used in the construction of playgrounds on school property.

AN ACT to amend the education law, in relation to  funding  for  certain
  remedial reconstruction on school playgrounds

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 414 of the education law is amended by adding a new
subdivision 3 to read as follows:
  3. THE TRUSTEES OR BOARD OF EDUCATION SHALL DETERMINE  IF  PLAYGROUNDS
ERECTED ON SCHOOL PROPERTY CONTAIN WOOD OR WOOD PRODUCTS WHICH HAVE BEEN
TREATED  WITH  CHROMATED  COPPER  ARSENATE, AND PROVIDE FOR THE REMOVAL,
REPLACEMENT OR SEALING OF SUCH WOOD OR WOOD PRODUCTS.  THE  COMMISSIONER
MAY  AUTHORIZE  AN  APPROPRIATE  GRANT TO OFFSET ALL OR A PORTION OF THE
COST TO THE DISTRICT FOR SUCH REMEDIAL ACTIVITY. THE  REMEDIATION  SHALL
BE  COMPLETED  ON  OR BEFORE THE FIRST DAY OF SEPTEMBER IN THE YEAR NEXT
SUCCEEDING THE YEAR IN WHICH THIS SUBDIVISION SHALL HAVE BECOME A LAW.
  S 2. Section 305 of the education law  is  amended  by  adding  a  new
subdivision 42 to read as follows:
  42. THE COMMISSIONER MAY PROVIDE GRANTS TO SCHOOL DISTRICTS TO OFFSET,
IN  WHOLE  OR  IN  PART,  THE  COST  OF REMEDIAL ACTION TAKEN TO REMOVE,
REPLACE OR SEAL WOOD OR WOOD PRODUCTS,  WHICH  HAVE  BEEN  TREATED  WITH
CHROMATED  COPPER ARSENATE, AND WERE USED IN CONSTRUCTING PLAYGROUNDS ON
SCHOOL PROPERTY.
  S 3. This act shall take effect immediately.
