BILL NUMBER:A7427 REVISED 1/14/10 TITLE OF BILL: An act to amend chapter 203 of the laws of 1999 amending the environmental conservation law relating to extending Nassau county's authority to initiate and enforce certain actions, in relation to the extension of Nassau county's authority to initiate and enforce certain actions PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to extend the authority of Nassau County to enforce certain provisions of the ECL related to water pollution. SUMMARY OF SPECIFIC PROVISIONS: This bill would extend until October 1, 2011 Nassau County's authority to initiate and enforce certain provisions of the ECL related to water pollution control, including the general prohibition against pollution and pollution of the marine district, and for the control of bulk storage of petroleum. JUSTIFICATION: This legislation seeks to keep the Nassau County Health Commissioner able to enforce certain provisions of the Environmental Conservation Law, Provisions include, water pollution control, a general prohibition against pollution.and pollution of the marine district, and for the control of bulk storage of petroleum. PRIOR LEGISLATIVE HISTORY: Last extended by Chapter 246 of the Laws of 2007.

WEISENBERG -- read once and referred to the Committee on Environmental Conservation AN ACT to amend chapter 203 of the laws of 1999 amending the environ- mental conservation law relating to extending Nassau county's authori- ty to initiate and enforce certain actions, in relation to the exten- sion of Nassau county's authority to initiate and enforce certain actions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2 of chapter 203 of the laws of 1999 amending the environmental conservation law relating to extending Nassau county's authority to initiate and enforce certain actions, as amended by chapter 246 of the laws of 2007, is amended to read as follows: S 2. This act shall take effect on October 1, 1999, and shall remain in force and effect until October 1, [2009] 2011, on which date it shall expire and be deemed repealed. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10912-01-9
