AN ACT to authorize and enable Geraldine  A.  Klapp  to  obtain  tier  I
  status with the New York state and local employees' retirement system

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any inconsistent provision of  law,  Geral-
dine  A. Klapp, a retired member of the New York state and local employ-
ees' retirement system with tier IV status, who was formerly employed by
Erie #1 BOCES on a part-time basis from November 4, 1966 to February 10,
1967, who, for reasons not ascribable to her  own  negligence,  did  not
become  a  member  of the New York state and local employees' retirement
system during such period; and who was a  career  employee  at  Erie  #1
BOCES, shall be deemed to have become a member of such retirement system
as of November 4, 1966 with tier I status, and shall have her retirement
benefit  recalculated and paid retroactive to her date of retirement, if
on or before December 31, 2009, she files a  written  request  for  such
status with the state comptroller.
  S 2. This act shall take effect immediately.
  FISCAL NOTE.--Pursuant to Legislative Law, Section 50:
  This  bill  would  grant Tier 1 status in the New York State and Local
Employees' Retirement System to retiree Geraldine A. Klapp,  by  deeming
her  to  have  become  a  member of such System on November 4, 1966. Her
pension will be recalculated as of her date of retirement.
  If this bill is enacted, there will be an immediate past service  cost
of  approximately  $90,900 which will be shared by the State of New York
and all of the participating employers of the New York State  and  Local
Employees' Retirement System.
  This  estimate,  dated  February  25,  2009  and intended for use only
during the 2009  Legislative  Session,  is  Fiscal  Note  No.  2009-169,
prepared  by  the  Actuary  for  the New York State and Local Employees'
Retirement System.
