S T A T E O F N E W Y O R K ________________________________________________________________________ 7596 2009-2010 Regular Sessions I N A S S E M B L Y April 16, 2009 ___________ Introduced by M. of A. GALEF -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to requiring the state board of elections to compile election results of every municipality in this state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 9-213 to read as follows: S 9-213. STATE BOARD OF ELECTIONS TO COMPILE ALL ELECTION RESULTS. 1. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ALL COUNTY BOARDS OF ELECTIONS SHALL CAUSE A COPY OF ANY AND ALL DETERMINATIONS OF EACH COUNTY, CITY, TOWN OR VILLAGE ELECTION AND ANY PROPOSITIONS OR BOND REFERENDA APPEARING ON ANY BALLOT IN ANY MUNICIPALITY OF THIS STATE TO BE TRANSMITTED TO THE STATE BOARD OF ELECTIONS. 2. THE STATE BOARD OF ELECTIONS SHALL: (A) DEVELOP AN ELECTRONIC REPORTING SYSTEM TO PROCESS ALL ELECTIONS RESULTS PURSUANT TO THE PROVISIONS OF THIS SECTION; (B) PRESCRIBE THE INFORMATION REQUIRED IN THE FORM FOR EACH STATEMENT TO BE FILED; (C) ESTABLISH A TRAINING PROGRAM ON THE ELECTRONIC REPORTING PROCESS AND MAKE IT AVAILABLE TO ANY SUCH COUNTY BOARD OF ELECTIONS; (D) MAKE THE ELECTRONIC REPORTING PROCESS AVAILABLE TO ANY COUNTY BOARD OF ELECTIONS WHICH IS REQUIRED TO FILE OR WHICH AGREES TO FILE SUCH STATEMENTS BY SUCH ELECTRONIC REPORTING PROCESS; (E) CAUSE ALL INFORMATION CONTAINED IN SUCH A STATEMENT FILED WITH THE STATE BOARD OF ELECTIONS WHICH IS NOT ON SUCH ELECTRONIC REPORTING SYSTEM TO BE ENTERED INTO SUCH SYSTEM AS SOON AS PRACTICABLE BUT IN NO EVENT LATER THAN TEN BUSINESS DAYS AFTER ITS RECEIPT BY THE STATE BOARD OF ELECTIONS; AND (F) MAKE ALL DATA FROM ELECTRONIC REPORTING PROCESS AVAILABLE AT ALL TIMES ON THE INTERNET.
