AN  ACT  to  amend  the  environmental  conservation law, in relation to
  prohibiting the administration of experimental compounds on wildlife

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  11-0107 of the environmental conservation law is
amended by adding a new subdivision 3 to read as follows:
  3. NO PERSON, CORPORATION, GOVERNMENTAL AGENCY OR DEPARTMENT,  OR  ANY
OTHER  LEGAL  OR  GOVERNMENTAL  ENTITY  SHALL CONDUCT EXPERIMENTS ON, OR
OTHERWISE ADMINISTER EXPERIMENTAL DRUGS, VACCINES, CHEMICAL  AGENTS,  OR
COMPOUNDS  TO  WILDLIFE UNLESS SUCH EXPERIMENTAL DRUG, VACCINE, CHEMICAL
AGENT, OR COMPOUND IS APPROVED FOR USE ON SUCH WILDLIFE  BY  EITHER  THE
UNITED  STATES  FOOD AND DRUG ADMINISTRATION OR ENVIRONMENTAL PROTECTION
AGENCY. FOR THE PURPOSES OF THIS SUBDIVISION, THE TERM "WILDLIFE"  SHALL
MEAN  WILD  GAME  AND  ALL  OTHER  ANIMAL LIFE EXISTING IN A WILD STATE,
INCLUDING FISH,  SHELLFISH,  AND  CRUSTACEA.  ANY  PERSON,  CORPORATION,
GOVERNMENTAL  AGENCY  OR  DEPARTMENT, OR ANY OTHER LEGAL OR GOVERNMENTAL
AGENCY VIOLATING THIS SUBDIVISION SHALL BE GUILTY OF A MISDEMEANOR.
  S 2. This act shall take effect immediately.
