AN ACT to require the metropolitan transit authority to include accessi-
  bility in mass  transit  and  rapid  transit  stations  whenever  such
  authority makes major capital improvements to such stations

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any law, administrative code, act, rule  or
regulation  to  the  contrary,  the  metropolitan  transit authority, as
established by section 1263 of the public  authorities  law,  is  hereby
required  to  remove  architectural  and communication barriers that are
structural in nature and to make alterations necessary to ensure  access
by  persons  with  disabilities  in  each existing mass transit or rapid
transit station within that portion of the metropolitan commuter  trans-
portation district, as established by section 1262 of the public author-
ities  law, that is within the boundaries of the city of New York, when-
ever such authority makes alterations to  such  mass  transit  or  rapid
transit  station,  unless such authority can demonstrate that such addi-
tional alterations or removal of such architectural barriers or communi-
cation barriers would result in an undue burden.
  S 2. This act shall take effect immediately.
