  tee on Governmental Operations

AN ACT to amend the  executive  law,  in  relation  to  authorizing  the
  commission  on  public  integrity  to impose a penalty for acting with
  intent to obstruct a commission investigation

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Short title.  This act shall be known and may be cited as
the "public integrity commission enforcement act".
  S 2.  Section 94 of the executive law  is  amended  by  adding  a  new
subdivision 13-b to read as follows:
  13-B.  IF  THE  COMMISSION  HAS A REASONABLE BASIS TO BELIEVE THAT ANY
PERSON OR ENTITY SUBJECT TO THE COMMISSION'S JURISDICTION HAS FAILED  TO
COMPLY  WITH COMMISSION SUBPOENAS OR OTHER DIRECTIVES ISSUED IN CONJUNC-
TION WITH AN ON-GOING COMMISSION  INVESTIGATION,  THE  COMMISSION  SHALL
HAVE THE AUTHORITY TO IMPOSE A PENALTY OF UP TO TEN THOUSAND DOLLARS FOR
ACTING WITH INTENT TO OBSTRUCT A COMMISSION INVESTIGATION.
  S 3. This act shall take effect immediately.
