REILLY -- read once and referred to the Committee on Governmental Employees AN ACT granting retroactive membership in the New York state and local employees' retirement system to Jeffrey W. Green THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other law to the contrary, Jeffrey W. Green, who was employed by the town of Colonie as a lifeguard from June 11, 1968 through August 1968 and as a playground director from June 1969 through August 1969, and who is currently a Tier 1 member of the New York state and local employees' retirement system, who through no fault of his own did not become a member of the New York state and local employees' retirement system in June of 1968 when first employed by the town of Colonie, shall be deemed to have been a member of the New York state and local employees' retirement system on such date he commenced such employment and such employment shall be included in the calculation of his final average salary, provided that an application is filed with the state comptroller within one year from the effective date of this act. S 2. Any costs incurred pursuant to this act shall be borne by the state of New York. S 3. Notwithstanding any other provision of law, no employee contrib- utions shall be returned to Jeffrey W. Green pursuant to this act. S 4. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill would deem Jeffrey W. Green, an employee of New York State and currently a Tier 1 member of the New York State and Local Employees' Retirement System, to have first become a member of the Retirement System on June 11, 1968, thereby making him eligible for the inclusion of up to 30 days of lump sum vacation in the calculation of his final average salary.
