AN ACT in relation to requiring the New York Racing Association to study
  horse racing and breeding across New York

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Legislative  findings.  The  legislature hereby finds and
determines that the sport and business  of  horse  racing  are  valuable
social  and  economic  assets,  and that the people and the state have a
long tradition of support for and legislation concerning maintenance and
expansion of horse racing and breeding. The  legislature  further  finds
and  determines  that  the health and safety of both the animals and the
people who make up the racing community are  a  paramount  concern,  and
that  such  concern should be reflected in continuing monitoring, analy-
sis, and reform of industry practices to achieve the  highest  level  of
safety and protection.
  S  2.  The  New  York Racing Association shall conduct or commission a
full inquiry, analysis and review of the policies and practices of horse
racing and breeding across New York state to insure the  safety,  health
and protection of horses, and report to the governor and legislature the
results  of  this  effort  no  later than December 15, 2009. Such report
shall include, but not limited to, issues of track safety, use of drugs,
breeding policies and practices, the incidence of  accident  and  injury
over time, regulation by racing authorities, alternative policies, prac-
tices  and  technologies  likely  to reduce injury and accident, and the
impact of the above on the health and safety of persons associated  with
horse  racing, and any other issues or information relevant to assessing
and improving animal safety. Full cooperation shall be extended  to  the
association's inquiry and report by all state agencies and institutions.
  S 3. This act shall take effect immediately.
