AN ACT to amend chapter 605  of  the  laws  of  2000,  relating  to  the
  construction  of  new  educational  facilities,  the financing of such
  facilities, and the financing of the rehabilitation and reconstruction
  of existing facilities in the city of Buffalo, in relation  to  appor-
  tionment of building aid

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 16 of chapter 605 of the laws of 2000  relating  to
the  construction  of  new educational facilities, the financing of such
facilities, and the financing of the rehabilitation  and  reconstruction
of  existing  facilities  in the city of Buffalo, is amended by adding a
new subdivision (k) to read as follows:
  (K) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, BUILD-
ING AID FOR PROJECTS AUTHORIZED PURSUANT TO PARAGRAPH (IV)  OF  SUBDIVI-
SION (B) OF THIS SECTION SHALL BE ELIGIBLE FOR AN APPORTIONMENT COMPUTED
PURSUANT TO CLAUSE (C) OF SUBPARAGRAPH 2 OF PARAGRAPH C OF SUBDIVISION 6
OF  SECTION  3602  OF THE EDUCATION LAW, REGARDLESS OF THE DATE ON WHICH
SUCH PROJECTS WERE APPROVED BY THE BOARD OF EDUCATION.
  S 2. This act shall take effect July 1, 2009.
