AN ACT in relation to granting full duty police officer status to John
  O'Neill

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Notwithstanding any provision of law to the contrary, John
O'Neill, a member of the New York state and local police and fire
retirement system, who is employed as a police officer by the Nassau
county police department, who received a serious injury while arresting
an individual on duty, and who filed a timely application for accidental
disability retirement with such retirement system, shall be deemed to be
a full duty police officer for the purposes of determining his applica-
tion for accidental disability retirement.
S 2. Any costs attributable to this act shall be borne by the county
of Nassau.
S 3. This act shall take effect immediately, and shall be deemed to
have been in full force and effect on the date John O'Neill initially
made application for accidental disability retirement with the New York
state and local police and fire retirement system.
FISCAL NOTE.--This bill would deem John K. O'Neill, a member of the
New York State and Local Police and Fire Retirement System, to be a full
duty police officer for the purposes of determining his eligibility for
an accidental disability.
If this bill is enacted and Officer John K. O'Neill is ultimately
granted an accidental disability, there will be a cost of approximately
$288,000 which will be borne by Nassau County as a one-time payment.
This estimate is based on the assumption that payment will be made
February 1, 2010.
This estimate, dated February 10, 2009, and intended for use only
during the 2009 Legislative Session, is Fiscal Note No. 2009-107,
prepared by the Actuary for the New York State and Local Police and Fire
Retirement System.
