S T A T E O F N E W Y O R K ________________________________________________________________________ 8520 2009-2010 Regular Sessions I N A S S E M B L Y May 26, 2009 ___________ Introduced by M. of A. SWEENEY, WEISENBERG, ALESSI, HOOPER, JAFFEE, FIELDS, LAVINE, EDDINGTON, ZEBROWSKI, RAMOS, ENGLEBRIGHT, SCHIMEL, GALEF -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to a regional bus system for the metropolitan transportation authority district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative intent. The legislature hereby finds and declares that public transportation is integral to the economic vitality of New York and a key component of solutions to climate change. Accessi- ble, affordable and comprehensive mass transit systems lower costs and improve the standard of living for millions. This legislation will provide opportunities to improve transportation options, increase effi- ciency, cut air pollution and reduce property taxes. S 2. The public authorities law is amended by adding a new section 1279-d to read as follows: S 1279-D. REGIONAL BUS AUTHORITY. 1. THE AUTHORITY IS AUTHORIZED AND EMPOWERED TO CREATE AND MAINTAIN A REGIONAL BUS AUTHORITY, CONSISTING OF METROPOLITAN TRANSPORTATION AUTHORITY BUS, LONG ISLAND BUS AND ANY OTHER BUS SYSTEM AS REQUESTED BY THE LEGISLATIVE BODY OF ANY COMPETENT JURIS- DICTION LOCATED WITHIN THE TRANSPORTATION DISTRICT. 2. UPON A RESOLUTION ADOPTED BY THE LEGISLATIVE BODY OF ANY MUNICI- PALITY LOCATED WITHIN THE TRANSPORTATION DISTRICT, THE AUTHORITY IS AUTHORIZED TO IMPLEMENT THE PURCHASE OF SUCH BUS SYSTEM IN A MANNER CONSISTENT WITH ALL APPLICABLE FEDERAL AND STATE LAWS. UPON SUCH ACQUI- SITION, ALL ASSETS OF SUCH BUS SYSTEM SHALL BECOME THE PROPERTY OF THE AUTHORITY, ITS AGENTS AND AFFILIATES. 3. UPON THE PURCHASE OF SUCH SYSTEM BY THE AUTHORITY, ALL STATE AND FEDERAL SUBSIDIES WHICH WERE PROVIDED TO THE ACQUIRED ENTITY SHALL BECOME THE PROPERTY OF THE AUTHORITY. THE AUTHORITY IS AUTHORIZED TO APPLY FOR ALL APPLICABLE FEDERAL AND STATE GRANTS FOR THE PURPOSE OF OPERATING SUCH A BUS SYSTEM. S 3. This act shall take effect January 1, 2010.
