BILL NUMBER:A8579 TITLE OF BILL: An act to amend the general municipal law, in relation to establishing the town of Yorktown industrial development agency; and to repeal section 925-s of such law relating thereto PURPOSE: This legislation recreates the Town of Yorktown Industrial Development Agency and provides for its functions, powers, and duties. SUMMARY OF PROVISIONS: Section 1. Section one of this legislation amends the General Municipal Law by repealing section 923-s and adding a new section to recreate the Town of Yorktown Development Agency. JUSTIFICATION: Industrial Development Agencies in New York State are created to promote the economic welfare and prosperity of the inhabit- ants of a municipality or county. Further it is their function to actively attract and encourage development in the area in question. Pursuant to General Municipal. Law section B56(1)(b)(2), an Industrial Development Agency ceases to exist if at the expiration of tem years, there are no outstanding bonds or other obligations. Since the Town of Yorktown Industrial Development Agency has no outstanding band as required by statute, they are no longer considered in existence. Thus, this legislation reestablishes the Industrial Development Agency in the Town of Yorktown which is located in Westchester County. Many

BALL -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to establishing the town of Yorktown industrial development agency; and to repeal section 925-s of such law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 925-s of the general municipal law is REPEALED and a new section 925-s is added to read as follows: S 925-S. TOWN OF YORKTOWN INDUSTRIAL DEVELOPMENT AGENCY. FOR THE BENE- FIT OF THE TOWN OF YORKTOWN AND THE INHABITANTS THEREOF, AN INDUSTRIAL DEVELOPMENT AGENCY, TO BE KNOWN AS THE TOWN OF YORKTOWN INDUSTRIAL DEVELOPMENT AGENCY, IS HEREBY ESTABLISHED FOR THE ACCOMPLISHMENT OF ANY OR ALL OF THE PURPOSES SPECIFIED IN TITLE ONE OF ARTICLE EIGHTEEN-A OF THIS CHAPTER. IT SHALL CONSTITUTE A BODY CORPORATE AND POLITIC, AND BE PERPETUAL IN DURATION. IT SHALL HAVE THE POWERS AND DUTIES NOW OR HERE- AFTER CONFERRED BY TITLE ONE OF ARTICLE EIGHTEEN-A OF THIS CHAPTER UPON INDUSTRIAL DEVELOPMENT AGENCIES AND PROVIDED THAT THE EXERCISE OF THE POWERS BY SUCH AGENCY WITH RESPECT TO THE ACQUISITION OF REAL PROPERTY WHETHER BY PURCHASE, CONDEMNATION OR OTHERWISE, SHALL BE LIMITED TO THE CORPORATE LIMITS OF THE TOWN OF YORKTOWN, AND SUCH AGENCY SHALL TAKE INTO CONSIDERATION THE LOCAL ZONING AND PLANNING REGULATIONS AS WELL AS THE REGIONAL AND LOCAL COMPREHENSIVE LAND USE PLANS. IT SHALL BE ORGAN- IZED IN A MANNER PRESCRIBED BY AND BE SUBJECT TO THE PROVISIONS OF TITLE ONE OF ARTICLE EIGHTEEN-A OF THIS CHAPTER. ITS MEMBERS SHALL BE APPOINTED BY THE GOVERNING BODY OF THE TOWN OF YORKTOWN. THE AGENCY, ITS MEMBERS, OFFICERS AND EMPLOYEES AND ITS OPERATIONS AND ACTIVITIES SHALL IN ALL RESPECTS BE GOVERNED BY THE PROVISIONS OF TITLE ONE OF ARTICLE EIGHTEEN-A OF THIS CHAPTER. S 2.
