BILL NUMBER:A8584 TITLE OF BILL: An act to amend the parks, recreation and historic pres- ervation law, in relation to free use of campsites, parks and public places of recreation by veterans PURPOSE OR GENERAL IDEA OF BILL: This bill will waive admission fees for.combat veterans to parks, campgrounds and other places of public recreation maintained by the State or by a municipality that received $100,000 or more in state aid or grants for acquisition, improvement or maintenance of such facilities in the previous year. SUMMARY OF PROVISIONS: Bill . 1 adds a new subdivision 2 to § 13.19 of the Parks, Recreation & Historic Preservation Law to provide that any veteran who served in the armed forces of the United States during a time of war (as defined in Civil Service Law §185(1)(c)) shall be permitted to use any of the public campsites, parks and other public places of recreation in this state without the payment of any fees or other charges. The provisions of subdivision 2 also apply to campsites, parks and places of public recreation maintained by a municipality which has received state aid or grants in the amount of $100,000 or more in the previous year for acquisition, improvement or maintenance of camp- sites, parks and other public places of recreation. The provisions of subdivision 2 do not apply to disabled combat veterans who are already exempted from fee payment pursuant to the existing terms of § 13.19.

MOLINARO, SAYWARD -- read once and referred to the Committee on Veterans' Affairs AN ACT to amend the parks, recreation and historic preservation law, in relation to free use of campsites, parks and public places of recre- ation by veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 13.19 of the parks, recreation and historic preser- vation law, as amended by chapter 649 of the laws of 1977, is amended to read as follows: S 13.19 Free use of campsites. 1. Notwithstanding the provisions of any other law, any person who is blind, non-ambulatory, or an amputee or any veteran of the wars of the United States, who has at any time been awarded by the federal government an allowance towards the purchase of an automobile or is eligible for such an award shall be permitted to use any of the public campsites, parks and other public places of recreation in this state, upon the same terms and conditions as apply to the gener- al public, but without the payment of any fees or other charges for the use of such campsites, parks and other public places of recreation. 2. NOTWITHSTANDING THE PROVISIONS OF ANY OTHER LAW, ANY VETERAN WHO SERVED IN THE ARMED FORCES OF THE UNITED STATES DURING A TIME OF WAR, AS DEFINED IN PARAGRAPH (C) OF SUBDIVISION ONE OF SECTION EIGHTY-FIVE OF THE CIVIL SERVICE LAW, OTHER THAN A VETERAN WHO IS PERMITTED FREE USE OF PUBLIC CAMPSITES, PARKS AND OTHER PUBLIC PLACES OF RECREATION PURSUANT TO SUBDIVISION ONE OF THIS SECTION, SHALL BE PERMITTED TO USE ANY OF THE PUBLIC CAMPSITES, PARKS AND OTHER PUBLIC PLACES OF RECREATION IN THIS STATE, UPON THE SAME TERMS AND CONDITIONS AS APPLY TO THE GENERAL PUBLIC, BUT WITHOUT THE PAYMENT OF ANY FEES OR OTHER CHARGES FOR THE USE OF SUCH CAMPSITES, PARKS AND OTHER PUBLIC PLACES OF RECREATION. THE PROVISIONS OF THIS SUBDIVISION SHALL ALSO APPLY TO CAMPSITES, PARKS AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09072-01-9
