BILL NUMBER:A8608 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the regulation of idling by local authorities and school districts PURPOSE OR GENERAL IDEA OF BILL: This bill authorizes the regulation of vehicle idling by school districts and local authorities. SUMMARY OF PROVISIONS: Bill §1 amends subdivision 1 of §1670 of the Vehicle & Traffic Law, which currently allows school districts and local authorities to regulate stopping standing and parking with respect to driveways and parking areas accessory to any school, playground, park, building or facility under their jurisdiction. The amendments would add "idling" of vehicles to the list of activities that can be so regulated. EFFECTS OF PRESENT LAW WHICH THIS BILL WOULD ALTER: There is currently no provision for regulation of idling by school districts or local authorities. JUSTIFICATION: Emissions from school buses and other motor vehicles can exacerbate respiratory problems and contribute to asthma and other health problems for children. Children are particularly vulnerable to air pollution because, compared to adults, they breathe at a faster rate and inhale a greater volume of air per pound of body weight.

MENG -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the regu- lation of idling by local authorities and school districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 1670 of the vehicle and traffic law is amended to read as follows: 1. Prohibit, restrict or limit the stopping, standing, IDLING or park- ing of vehicles. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03916-01-9
