BILL NUMBER:A8649 TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating civil deputies of the Onondaga county sheriff's depart- ment as peace officers PURPOSE: To designate civil deputies employed by the Onondaga County Sheriff's office as peace officers. SUMMARY OF PROVISIONS: Section One. Amends §2.10 of the Criminal proce- dure Law by adding a new Subdivision 81, designating civil deputies employed by the Onondaga County Sheriff's department as peace officers. Section Two. Immediate effective date. JUSTIFICATION: Civil deputies employed by the Onondaga County Sheriff's office are responsible for serving civil court papers and also for seiz- ing property, supervising evictions and supervising sales of seized property. The performance of these duties requires specialized knowledge to interact with the public in potentially hazardous situations. By having peace officer status, these civil deputies will receive training which aids them in the performance of their duties. The proposed desig- nation has been requested by the Onondaga County Sheriff's office. LEGISLATIVE HISTORY: New bill.

BARCLAY -- read once and referred to the Commit- tee on Codes AN ACT to amend the criminal procedure law, in relation to designating civil deputies of the Onondaga county sheriff's department as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. CIVIL DEPUTIES EMPLOYED BY THE ONONDAGA COUNTY SHERIFF'S DEPART- MENT; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH EMPLOYEES TO CARRY, POSSESS, REPAIR, OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
