BILL NUMBER:A8654 TITLE OF BILL: An act to amend the education law, in relation to the definition of child sexual abuse PURPOSE OR GENERAL IDEA OF BILL: To expand the conduct defined as child sexual abuse to include stalking and luring. SUMMARY OF SPECIFIC PROVISIONS: Amends Subdivision 9 of section 1125 of the Education Law to include sections of the Penal law which define stalking and luring conduct as child sexual offenses in the education law. JUSTIFICATION: This bill will expand the conduct which is treated as child sexual offenses under the education law to those activities pres- ently not included but clearly are a danger to children. In an educa- tional setting, students interact with school employees on a daily basis. While the vast majority of communication between adults and chil- dren are positive, there are some cases where unwarranted dialogue is used which may impact a student PRIOR LEGISLATIVE HISTORY: New FISCAL IMPLICATIONS: None EFFECTIVE DATE: Immediately

MILLER -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the definition of child sexual abuse THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 9 of section 1125 of the education law, as added by chapter 180 of the laws of 2000, is amended to read as follows: 9. "Child sexual abuse" shall mean conduct prohibited by article one hundred thirty or two hundred sixty-three of the penal law, OR CONDUCT PROHIBITED BY SECTION 120.45, 120.50, 120.55, 120.60, OR 120.70 OF THE PENAL LAW. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10802-01-9
