BILL NUMBER:A8671 TITLE OF BILL: An act to amend the civil service law, in relation to appointments to the exempt or non-competitive class PURPOSE OF THE BILL: The purpose of this bill is to require that employing agency making appointments to the exempt or non-competitive class must first consider qualified employees from the competitive class before considering other candidates for the position. SUMMARY OF PROVISIONS: Section 1 of the bill add a new section forty- two-a to the Civil Service Law) to require that employing agency making appointments to the exempt or non-competitive class must first consider qualified employees from the competitive class before considering other candidates for the position. Section 2 of the bill makes this act effective immediately. LEGISLATIVE HISTORY: New. STATEMENT IN SUPPORT: The purpose of the civil service system is to ensure employment and promotion of merit, education and talent. This bill seeks to preserve the integrity of that system by requiring the use of the transfer list to fill same or comparable titles. BUDGET IMPLICATIONS: None.

ABBATE -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to appointments to the exempt or non-competitive class THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The civil service law is amended by adding a new section 42-a to read as follows: S 42-A. APPOINTMENTS TO THE EXEMPT OR NON-COMPETITIVE CLASS. WITH RESPECT TO APPOINTMENTS IN THE CLASSIFIED SERVICE OF THE STATE NO APPOINTMENT SHALL BE MADE TO THE EXEMPT CLASS OR NON-COMPETITIVE CLASS BEFORE A LIST OF QUALIFIED EMPLOYEES HAS BEEN ESTABLISHED FROM THE COMPETITIVE CLASS. THE HIRING AGENCY MUST CANVAS AND INTERVIEW ANY INTERESTED CANDIDATES FROM SUCH LIST. NO APPOINTMENT MAY BE MADE OTHER THAN FROM THE ESTABLISHED LIST UNLESS IT IS DETERMINED THAT THERE IS NO AVAILABLE PERSON QUALIFIED TO PERFORM THE DUTIES OF SUCH POSITION. S 2.
