AN  ACT  to  amend the civil service law, in relation to appointments to
  the exempt or non-competitive class

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  civil service law is amended by adding a new section
42-a to read as follows:
  S 42-A. APPOINTMENTS TO THE  EXEMPT  OR  NON-COMPETITIVE  CLASS.  WITH
RESPECT  TO  APPOINTMENTS  IN  THE  CLASSIFIED  SERVICE  OF THE STATE NO
APPOINTMENT SHALL BE MADE TO THE EXEMPT CLASS OR  NON-COMPETITIVE  CLASS
BEFORE  A  LIST  OF  QUALIFIED  EMPLOYEES  HAS BEEN ESTABLISHED FROM THE
COMPETITIVE CLASS. THE HIRING  AGENCY  MUST  CANVAS  AND  INTERVIEW  ANY
INTERESTED  CANDIDATES  FROM SUCH LIST. NO APPOINTMENT MAY BE MADE OTHER
THAN FROM THE ESTABLISHED LIST UNLESS IT IS DETERMINED THAT THERE IS  NO
AVAILABLE PERSON QUALIFIED TO PERFORM THE DUTIES OF SUCH POSITION.
  S 2. This act shall take effect immediately.
