BILL NUMBER:A8746 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to wine auctions on the internet PURPOSE OR GENERAL IDEA OF BILL: Would amend the alcoholic beverage control law to define the parameters of Internet auctions for wine or liquor as authorized by law. This bill exempts internet auctions from the current numerical limitations of twelve auctions during the period of effect for a wine and liquor auction permit. SUMMARY OF SPECIFIC PROVISIONS: Amends Section l Paragraph (b) of subdivision 2 of section 99-g of the alcoholic beverage control law to clarify that the numerical limitation of twelve wine or liquor auctions shall not include internet auctions. JUSTIFICATION: This bill addresses the residual lack of clarity to the status of internet auctions in relation to wine and liquor auctions covered by statute. PRIOR HISTORY: New Bill FISCAL IMPLICATIONS: unknown EFFECTIVE DATE: This act shall take effect immediately.

ROSENTHAL -- read once and referred to the Committee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the alcoholic beverage control law, in relation to wine auctions on the internet THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 2 of section 99-g of the alco- holic beverage control law, as amended by chapter 530 of the laws of 2007, is amended to read as follows: (b) A wine and liquor auction permit shall be issued for a calendar year. A wine and liquor auction permit shall allow the holder to conduct twelve auctions of wine and/or liquor during the period the wine and liquor auction permit shall be in effect. THIS NUMERICAL LIMIT SHALL NOT INCLUDE INTERNET AUCTIONS OTHERWISE AUTHORIZED BY LAW. S 2. This act shall take effect immediately.
