BILL NUMBER:A8783 TITLE OF BILL: An act to amend the education law, in relation to the development of a model pesticide policy PURPOSE: The purpose of this legislation is to develop model pesticide policy. SUMMARY OF PROVISIONS: Section one amends the Education Law by adding a new section, 409-k, directing school districts to develop a model pesti- cide policy or adopt model policy developed by the Commissioner of the Department of Environmental Conservation. Such policy will include phys- ical, biological and mechanical control methods, the target pests being addressed and the types of pesticides to be used. JUSTIFICATION: School districts frequently make decisions regarding how to manage pests in public schools. This legislation would direct school districts to formulate model pesticide policy, or to adopt model poli- cies to be developed by the Commissioner of Environmental Conservation. LEGISLATIVE HISTORY: This is new legislation. FISCAL IMPLICATIONS: None EFFECTIVE DATE: This act shall take effect one year after the date on which. it shall have become law.

BRODSKY, SWEENEY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the development of a model pesticide policy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 409-k to read as follows: S 409-K. MODEL PESTICIDE POLICY. 1. EACH SCHOOL DISTRICT SHALL DEVELOP A MODEL PESTICIDE POLICY OR ADOPT THE MODEL POLICY DEVELOPED BY THE COMMISSIONER OF ENVIRONMENTAL CONSERVATION, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH. SUCH POLICY SHALL INCLUDE AT A MINIMUM, PHYS- ICAL, BIOLOGICAL AND MECHANICAL CONTROL METHODS, THE TARGET PESTS BEING ADDRESSED AND THE TYPES OF PESTICIDES TO BE USED. 2. A SCHOOL DISTRICT THAT HAS ADOPTED THE MODEL POLICY DEVELOPED BY THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION SHALL BE DEEMED TO HAVE FULFILLED THE REQUIREMENTS OF THIS SECTION. S 2.
