AN  ACT  to amend the education law, in relation to the development of a
  model pesticide policy

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The education law is amended by adding a new section 409-k
to read as follows:
  S 409-K. MODEL PESTICIDE POLICY. 1. EACH SCHOOL DISTRICT SHALL DEVELOP
A MODEL PESTICIDE POLICY OR ADOPT THE  MODEL  POLICY  DEVELOPED  BY  THE
COMMISSIONER  OF  ENVIRONMENTAL  CONSERVATION,  IN CONSULTATION WITH THE
COMMISSIONER OF HEALTH. SUCH POLICY SHALL INCLUDE AT  A  MINIMUM,  PHYS-
ICAL,  BIOLOGICAL AND MECHANICAL CONTROL METHODS, THE TARGET PESTS BEING
ADDRESSED AND THE TYPES OF PESTICIDES TO BE USED.
  2. A SCHOOL DISTRICT THAT HAS ADOPTED THE MODEL  POLICY  DEVELOPED  BY
THE  DEPARTMENT  OF  ENVIRONMENTAL  CONSERVATION SHALL BE DEEMED TO HAVE
FULFILLED THE REQUIREMENTS OF THIS SECTION.
  S 2. This act shall take effect one year after the date  on  which  it
shall have become a law.
