BILL NUMBER:A8876 TITLE OF BILL: An act to amend the retirement and social security law, in relation to allowing military service credit for all veterans honor- ably discharged from the military PURPOSE: This bill allows military service credit for all veterans honorably discharged from the military. SUMMARY OF PROVISIONS: Section 1- Section 1000 of the retirement and social security law, as added by chanter 547 of the laws of 2002. Section 2- Contains Effective Date. JUSTIFICATION: This bill would allow up to three years of service cred- it for military duty by removing all existing requirements that such military service he performed during certain war periods, during certain hostilities while in the theater of operations or upon the receipt of an expeditionary medal. This would then allow all veterans, no matter where or when they served in the military, to receive certain advantages in regards to the retirement system. PRIOR LEGISLATIVE HISTORY: New legislation. FISCAL IMPLICATIONS: None.

ALESSI -- read once and referred to the Committee on Governmental Employees AN ACT to amend the retirement and social security law, in relation to allowing military service credit for all veterans honorably discharged from the military THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1000 of the retirement and social security law, as added by chapter 548 of the laws of 2000 and subdivision 9 as added by chapter 547 of the laws of 2002, is amended to read as follows: S 1000. Military service credit. 1. Notwithstanding any law to the contrary, a member of a public retirement system of the state, as defined in subdivision twenty-three of section five hundred one of this chapter, shall be eligible for credit for military service [as herein- after provided: 1. A member, upon application to such retirement system, may obtain a total] not to exceed three years of service credit for up to three years of military duty, as defined in section two hundred forty-three of the military law, if the member was honorably discharged from the military [and all or part of such military service was rendered during the following periods: (a) commencing December seventh, nineteen hundred forty-one and terminating December thirty-first, nineteen hundred forty-six; (b) commencing June twenty-seventh, nineteen hundred fifty and terminating January thirty-first, nineteen hundred fifty-five; or (c) commencing February twenty-eighth, nineteen hundred sixty-one and terminating May seventh, nineteen hundred seventy-five; 2. A member, upon application to such retirement system, may obtain a total not to exceed three years of service credit for up to three years of military duty, as defined in section two hundred forty-three of the military law, if honorably discharged therefrom, if all or part of such EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
