BILL NUMBER:A8880 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the application of pesticides to drinking water PURPOSE OR GENERAL IDEA OF BILL: To prohibit the application of pesti- cides in bodies of water that are used as a source of drinking water. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends § 33-1301 of the envi- ronmental conservation law to prohibit the application of pesticides, except those used for the purpose of drinking water disinfection, in bodies of water that are used as a source of drinking water. JUSTIFICATION: Pesticides, when ingested, can pose a significant risk to human health, and thus, unless they are specifically being used for the purpose of drinking water disinfection they should not be applied to drinking water supplies. PRIOR LEGISLATIVE HISTORY: A11780 in 2006 FISCAL IMPLICATIONS: None EFFECTIVE DATE: This act shall take effect on thirtieth day after it shall have become a law.

FARRELL -- read once and referred to the Commit- tee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the application of pesticides to drinking water THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 33-1301 of the environmental conservation law is amended by adding a new subdivision 12 to read as follows: 12. FOR ANY PERSON TO APPLY ANY PESTICIDE TO A WATER BODY WITH A WATER SUPPLY INTAKE THAT IS USED FOR THE PURPOSE OF PROVIDING WATER FOR HUMAN CONSUMPTION, EXCEPT FOR PESTICIDES USED FOR THE PURPOSE OF DRINKING WATER DISINFECTION. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
